1. The road-sign rule: 2 of 4 must be correct. The test has 4 road-sign questions. If you get fewer than 2 right, you fail automatically — even if you answered all 16 road-rules questions perfectly. Never rush through the sign images.

2. No right turn on red in New York City. Across most of New York State (and the country), turning right on red is allowed after a complete stop unless posted otherwise. In New York City (all 5 boroughs), the rule is the exact opposite: no right turn on red is permitted unless a sign specifically says it is allowed.

3. Move Over Law applies to all hazard and service vehicles. When approaching any stopped emergency, hazard, or service vehicle display flashing amber, red, white, or blue lights on a multi-lane highway, drivers must vacate the lane closest to the vehicle if safe, or slow down significantly.

4. Blood Alcohol Concentration (BAC): 0.08% adult vs 0.02% Zero Tolerance. For drivers 21 and older, driving with a BAC of 0.08% is Driving While Intoxicated (DWI). For drivers under 21, New York’s Zero Tolerance Law makes it illegal to drive with a BAC of 0.02% to 0.07%.

5. Chemical test refusal (Implied Consent). If arrested for suspected impaired driving, refusing a chemical breath, blood, or urine test results in an immediate suspension and a mandatory revocation of your license for at least one year, plus a substantial civil penalty, even if found not guilty of the DWI charge.

6. Junior permit (Class DJ) driving restrictions. Junior learners under 18 may never drive in New York City under any circumstances. Outside NYC, they must always be supervised by a licensed parent, guardian, or instructor, and must observe regional passenger and night-hour curfews (typically 9 p.m. to 5 a.m.).

7. School bus with flashing red lights. You must stop from either direction on any road, divided highway, or multilane boulevard when a school bus has its red lights flashing and stop arm extended. You must remain stopped until the lights stop flashing or the driver signals you to proceed.

8. Following distance: the two-second rule. In good weather conditions, you should maintain at least a two-second following distance behind the vehicle ahead. Double or triple this buffer in rain, snow, or fog.

9. Parking distances from fire hydrants and crosswalks.

  • Fire hydrant: 15 feet (unless a licensed driver remains in the vehicle to move it).
  • Crosswalk at an intersection: 20 feet.
  • Traffic signal, stop sign, or yield sign: 30 feet.

10. Hydroplaning and wet pavement. On wet roadways, tires can lose contact with the road surface at speeds as low as 35 mph. If your vehicle begins to hydroplane, take your foot off the accelerator gradually and steer straight; do NOT slam on the brakes.
